about Pekao Financial Services Spółka z ograniczoną odpowiedzialnością (limited liability company) as distributor of investment fund participation units
(drawn up in accordance with the Regulation of the Minister of Finance of April 29, 2009 on the activity of entities acting as third-party distributors of participation units and titles to participation, further referred to as the “Regulation”)

Permit
Third-party distribution of participation units is conducted on the basis of permit No. DFN1-4051-167/01 issued by the Securities and Exchange Commission on November 20, 2001.

Basic Scope of Services
- collecting orders and other statements of intent from Clients related to participation in investment funds, including those placed by telephone, fax and mail,
- conveying orders placed by Clients, including Client order information in the form of electronic files, to the entity keeping the register of investment fund participants,
- handling complaints filed by Clients related to the conducted business.
Detailed principles regulating third-party distribution of participation units are contained in information prospectuses of investment funds whose participation units are distributed by Pekao FS.

Complaints
Complaints made by Clients in relation to the activities of Pekao FS may be lodged personally at the Client Service Center, via mail, over the following telephone numbers:

and via email: dystrybutor@pekao-fs.com.pl. Replies to complaints are issued within 14 days of the day they are received, with the exception of particularly complex matters, in the case of which the waiting period may be longer.

Conflict of Interest
Pekao FS has implemented and applies a policy aimed at preventing conflicts of interest. The policy indicates circumstances that bring about or may bring about a rise of conflict between the interests of Pekao FS and the Client related to significant risk of infringement of the Client’s interest. It also defines means and procedures for managing conflicts of interest. In circumstances where Pekao FS’s organization or internal regulations fail to ensure non-infringement of the Client’s interests in instances when conflict of interest does arise, information about the existing conflict will be disclosed to the Client prior to accepting his/her order. Expenses and Fees
The Client incurs expenses related to participation unit transactions - handling fee and management fee - to the amount indicated by investment fund companies in their information prospectuses and in abridged prospectuses of particular investment funds. Income tax is collected on earnings generated by participation in investment funds.

You can find below the adequacy test based on recommendations of Chamber of Fund and Asset Managers (IZFiA), pursuant to provisions of the Ordinance of Ministry of Finance, dated April 3, 2009. Positive score of the test means, that product – open investment fund – is adequate for investor. The score of the test should be treated for information purposes only. Fulfillment of the test is not equivalent of making by Pekao FS the assessment whether investment in fund is adequate for client. Principles for evaluating the test are placed at the end.
